Welcome to the New World. Planet Earth Network (“P.E.N.,” “Creator,” “we,” or “us”) is a revolutionary platform dedicated to the secure creation and verification of digital and physical assets. We understand that the future of trust requires flexibility, which is why we offer a hybrid ecosystem:

Whether you are minting Global I.D.s, issuing verifiable badges, securing critical documents, or accessing our physical ecosystem, Planet Earth Network provides the tools to authenticate reality. We aren't just adapting to the future; we are verifying the world that changed the universe.

BY CLICKING “I ACCEPT,” OR BY OTHERWISE ACCESSING OR USING THE SERVICE (AS DEFINED BELOW), YOU AGREE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING OUR PRIVACY POLICY (TOGETHER, THESE “TERMS”). IF YOU DO NOT AGREE TO THE TERMS, YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE.

1. Service Overview & Verification Tiers

We offer a hybrid web platform and decentralized application (the "Service") where users can register for Global I.D.s, mint digital assets, subscribe to memberships, and purchase verified physical merchandise (collectively, "Products").

  • Access Tiers: Access to certain features of the decentralized network of Planet Earth requires specific verification levels (Tier 1, Tier 2, or Tier 3). Your Tier determines your clearance and ability to mint, trade, or verify specific digital and physical assets.

  • Third-Party Infrastructure: Portions of our Service, such as physical merchandise sales or standard fiat processing, may be provided through third-party partners like Fourthwall.

2. Eligibility and Atmosphere Entry

The Service is available as an access web form for the decentralized network of Planet Earth, available to all who enter the atmosphere for registration, subject to the following:

  • You must be at least 13 years old to use the Service.

  • By agreeing to these Terms, you represent and warrant that: (a) you meet the age requirement; (b) you have not previously been suspended from the network; and (c) your registration complies with all applicable terrestrial and digital laws.

  • If you represent an entity or organization, you warrant that you have the authority to bind them to these Terms.

3. Accounts, Wallets, and Registration

To access Verification Tiers and Memberships, you must register.

  • Standard Accounts: You may be required to provide traditional data (name, email) for Standard Verification.

  • Decentralized Access: For Decentralized Verification, you may be required to connect a compatible digital wallet. You are solely responsible for maintaining the security of your account passwords, private keys, and seed phrases. P.E.N. cannot recover lost decentralized assets if you lose your credentials.

  • If you believe your account is compromised, notify us immediately at contact@support.planetearth.network.

4. General Payment & Minting Terms

Purchasing Products, Memberships, or minting Global I.D.s may require fees.

  • Fiat and Cryptographic Payments: Fees may be charged in U.S. Dollars or supported cryptographic assets. You will have the opportunity to review all fees before completing a transaction.

  • Gas Fees: Decentralized verification and asset creation may incur blockchain network fees ("gas fees"). You are solely responsible for these external network costs.

  • Authorization: You authorize P.E.N. and its payment processors to charge all sums for the Products, Memberships, and minting services you select to your specified payment method or connected wallet.

5. Memberships & Recurring Services

Memberships or ongoing Tier Verification may include automatically recurring periodic charges.

  • Your account/wallet will be charged automatically on the "Membership Billing Date" for the next period.

  • You may cancel your Membership before it renews to avoid the next periodic fee by accessing the Billing tab in your profile or contacting support.

6. Returns and Refunds

  • Physical Products: We accept returns for defective physical Products within 30 days of the purchase date. We will issue a full refund and cover return shipping for defective items. Non-defective returns are not accepted.

  • Digital & Decentralized Assets: Due to the immutable nature of blockchain technology, all minting fees, Global I.D. registrations, and digital asset purchases are final and non-refundable.

7. Asset Sovereignty and Licenses

  • Limited License to the Platform: P.E.N. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.

  • User Sovereignty: Digital assets and Global I.D.s minted via our Decentralized Verification infrastructure are owned entirely by the wallet holder, subject to the underlying smart contract protocols.

  • Ownership of Platform Materials: The visual interfaces, code, design, and general infrastructure of P.E.N. ("Materials") remain the intellectual property of P.E.N. and its licensors.

8. Prohibited Conduct

By using the Service, you agree NOT to:

  • Mint fraudulent Global I.D.s, impersonate any entity, or falsify your verification data for Tier 1, 2, or 3 access.

  • Use the Service for any illegal purpose or violate any third-party rights.

  • Interfere with security features, reverse-engineer smart contracts, or attempt to circumvent network protocols.

  • Upload malicious code, spyware, or disrupt the decentralized network infrastructure.

9. Modification and Termination

We reserve the right to change these Terms or modify/discontinue the Service at any time. We may suspend or terminate your access to the Service (or revoke your Verification Tier) at our sole discretion, with or without notice, if you violate these Terms.

10. Indemnity and Disclaimers

  • Indemnity: You agree to defend and indemnify P.E.N., its affiliates, and partners (including Fourthwall) from any claims, damages, or losses arising from your misuse of the Service, your violation of these terms, or identity disputes.

  • "AS IS" Basis: THE SERVICE, DECENTRALIZED INFRASTRUCTURE, AND ALL MATERIALS ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT RESPONSIBLE FOR BLOCKCHAIN DOWNTIME, WALLET COMPROMISES, OR THE LOSS OF DECENTRALIZED ASSETS.

  • Third-Party Liability: You acknowledge that third-party partners (like Fourthwall) are not parties to this agreement regarding your decentralized assets and will have no liability resulting from your use of the P.E.N. network.

11. Miscellaneous

  • Governing Law: These Terms are governed by the laws of the State of California without regard to conflict of law principles.

  • Electronic Communications: By using the Service, you consent to receive electronic communications from us.
